Intestancy: Passing Without Estate Planning - What Happens?

If a person passes on without estate planning of any kind, whether that planning is some kind of will or trust, they are said to have died intestate. Intestate law is the law that decides how assets are transferred and creditors satisfied if a person passes on without saying who gets the house, the car or the guarded family apple pie receipe. Intestacy law is a set of fall back provisions or rules that govern where the assets go, so that the state does not have to decide in each individual case what happens. Intestacy laws are like the default settings on computer program; they are there unless you intentionally alter them. Since most people die intestate, state intestacy laws govern how most people’s assets are distributed after their’ passing. Sometimes, even when a person has a valid will, if that will does not cover some portion of their property, then state intestacy laws will be used as gap-fillers or fallback measures so that all assets are covered.

Although state intestacy laws are best seen as a set of state laws that govern what happens to property left by those who did not make a will or trust, they also reflect some of the other needs a state has. First, states seem to make an attempt to ask what the normal person in the deceased place would want done with their assets. This is an important question because the answers given will reflect what state legislators think a “normal” person is and would want. It is easy for the legislature to over look non-traditional relationships, such as non-marital co-inhabitants, lesbian and gay life partners and children born out of wedlock or even stepchildren. This can bring about tremendous animosity among the people you care most about; so the best plan is to get a will or trust to protect those you love if nothing else.

However, your wishes are not the only goal that states keep in mind in drafting intestacy laws. The state may wish to maintain a system where parcels of land are owned by a single person rather than a group of people; because such groups have a tendency to sue each other over property they all have an interest in and this creates problems and expenses for the state itself. In addition, your state may have an avowed policy of attempting to promote “traditional family” relationships and use its power to craft intestacy laws to give assets to family members that the state deems more worthy. Even if you are someone who normally prefers more traditional family relationships, there is no guarantee that the relationships your state decides are traditional and your understanding of the traditional family will be the same.

Finally, you are in the best position to decide who is to have your assets, because you actually know the people involved; to the state the people involved are people who occupy abstract positions in your life, like spouse, child or parent. You are the one who is in the best position to decide who among your heirs should get something (or anything at all) from your estate, because these people play a greater role in your life than merely occupying some abstract position. They are the people you have laughed with, shared meals with, raised and have had raise you, cuddled with and loved. This is by no means to suggest that what people mean to you can only be known through your will or even be known through your will at all. It is rather to suggest that you should decide who gets what asset because you know what those around you value and enjoy. You should decide what happens with your assets, because chances are you earned them and should be the one to decide how they would best be passed on.

Sports Handicapping Lesson 1

If you are a casual bettor and do not mind losing your money to the man every wekk then this article is not for you. If you are looking at sports handicapping as a way to make money then this article is for you and should be regarded as your first lesson to successful sports handicapping.

The most common mistake that the lay bettor makes when analyzing a game is that they tend to bet favorites no matter the spread. The theory is that “Team A should beat Team B” so winning by X number of points is very likely. What you must realize is that the favorites are not looking at the spread when trying to win the game. How many times does a team have you bet on a favorite and seen them clearly winning the game only to lose against the spread at the last moment.

Clearly an equal number of favorites and underdogs win. The first thing you ought to do as a bettor would be to circle the underdogs that beat the spread and win outright for a couple of weeks and analyze them. Try to find patterns and situations that are common among all of them.

Business Loan Alternatives

After weeks of answering questions, providing endless financial statements and playing the “hurry up and wait” game you find out that your banker is unwilling to give you a business loan.

Reverse Mortgages More Favorable in ‘06

Senior homeowners can obtain a more generous reverse mortgage loan in 2006 than ever before – meaning they can convert a greater portion of the equity in their homes into tax-free income using one of these special mortgage plans. The new rules affect the federally insured Home Equity Conversion Mortgage (HECM) and the Fannie Mae Home Keeper reverse mortgages. About 90 percent of all reverse mortgage sales have been HECMs (insured via FHA).

Also, the U.S. House of Representatives recently passed legislation lifting the cap on the number of HECM reverse mortgages that can be issued — those that are insured by the Department of Housing and Urban Development (HUD). This legislation is still pending. There are now about 150,000 HECM mortgages outstanding. Lawmakers are very aware of the increasing popularity of reverse mortgage plans with senior homeowners.

Simply stated, a reverse mortgage is a means of tapping the equity in a home to generate a stream of addition monthly income for the owner. This income can continue until the homeowners sells or moves away from the home, or dies. As an alternative plan, the homeowner can receive a lump sum, activate a line of credit, or contract for a combination of these plans. The reverse mortgage is usually funded by a lending institution such as a mortgage lender, bank, credit union or savings and loan association. The borrower must be at least 62 years of age, own and occupy their home, and (in the case of HECMs) must participate in a consumer information session offered by an approved HECM counselor.

As for the increase amount of funds available this year, the HECM product varies by geographic area. The highest of the loan limits will grow from $312,896 to $362,790. These figures apply to most metro areas. Fannie Mae’s loan limit for single-family home mortgages, including its Home Keeper loans, have risen to $417,000 from last year’s $359,650.

Gain Muscle Mass

Gaining muscle mass is not that hard. Actually it is simple and straightforward. There is only one condition attached. That condition is you have to do it right.

Now many would say that of course you have to do it right. To gain mass you need to adhere to the basic principles regarding adding size to your frame.

As human beings we are all different. Different routines benefit different individuals. The same applies to diets. We all require different amounts of rest as well. However one thing remains true. We all gain muscle roughly the same way. Actually it is quite fortunate that we gain muscle the same way.

Just imagine if we all had totally different ways of adding muscle. It certainly would be very confusing.

I remember when I first started my muscle building journey. I learnt that building muscle is a combination training, nutrition and rest. This fact is so true. It always was and always will be.

When trying to add muscle everything you do revolves around these three principles. Bodybuilders constantly try to strike a balance between these three.

Fortunately for those trying to add mass there are these basic principles they need to stick to. If you follow these principles then your chances of success will be much greater.

Here are some basic guidelines for adding mass …

    • Consume lots of calories

    • Get enough protein

    • Train heavy

    • Get enough sleep and rest

As you can see from the above list, the basics are covered. It might seem easy but so many people do not even meet these basic requirements.

It is important to get the basics right. For example during an eight week cycle, every single day is important. If for just one day you do not meet your daily protein requirements you will be compromising your efforts.

Whenever I create an eating plan or training routine I make sure it is clear, concise and easy to follow. For many just following such a simple program is such a hard thing to do.

I know many guys who workout month after month and put on little mass. Most of the time the problem does not lie with their training. Due to sheer enthusiasm their training efficiency is quite good.

The problem mostly lies with their nutrition. I always feel that nutrition is so underrated. Nutrition forms the basis of a successful muscle building program. For example if your nutrition is only half of what it should be you are going to struggle. You will be building less muscle than you should be. This will not allow you to become stronger at a steady rate. As you might know more strength means more muscle.

Flight Delay

It took me eight years after my husband died to try a relationship, and now I am thinking maybe I should never have tried.

Over a year ago I met Jay. I always felt we had the perfect relationship. We like the same things, have the same type personality, and talked things through when there was a misunderstanding. A few days ago Jay came over, and after dinner he said he doesn’t want to see me anymore.

The next day he left a phone message saying he knows we have a relationship most people spend a lifetime searching for. He said he loves me and still wants me in his life, but to think of this as a break from each other and not a breakup.

I spent the last week crying and upset. Do I sit around and wait for him to call, and if he does, start the relationship over? Does this mean every time there is a difficult situation in his life he will push me out of it? Is there a chance there is more to this than he is saying?

As I waited for Tamara outside a shop today, I thought I saw a few falling leaves. Then I realized they were not leaves, but Monarch butterflies. The Monarchs’ flight is a bit erratic anyway, and the wind blew them around like leaves.

These butterflies are on their long migration from Canada to central Mexico. The Monarchs know when it is time for their journey to begin, and that is why you started dating again. It was time. Like the Monarchs, your flight may be a little erratic before you reach your true destination. Jay was just a little turbulence along the way.

I truly felt I found Mr. Right. He’s one of the few men I know who are considerate, open, and willing to make a difference in the world. He says he has chosen a lifestyle which is not the typical American one of over-consumption, designer brands, and expensive things.

I’ve moved to the city where he lives, staying with him until I find a room and a job. He says he wants for us to be in the same city, for me to be working and living my own life so he knows what we are like as a couple.

Recently I saw an e-mail he sent a friend. I know I broke the trust tenet by reading it, and I don’t know why I chose to read this particular e-mail, but it sounds like he wants to keep an open channel with her for possible future opportunities.

I felt love for him before I found out. Now I don’t know if I love him or not. I feel lucky to have found someone, but I don’t know if love will ever grow in his heart for me.

You attempted to verify one of two statements: he loves me, or he loves me not. Now you have the answer. If you allow him to determine the course of your relationship, he has all the power. He will do what he will do. That will not lead him to treat you with respect because you are not treating yourself with respect.

The History of Canon - From an Optical Lab to a Multimedia Giant!

Canon, according to the dictionary means is a general law, rule, principle or criterion; church decree or law; member of cathedral chapter; body of writings accepted as genuine.

Now what I am talking about is a company that manufactures user-friendly products! Canon the camera making company that now gives varied other products and services to the world such as printers, inks and fax machines and copiers!

Canon’s Roots

Canon’s roots were laid in 1933 with very few employees as a precision optical instruments lab. The Laboratory was founded in 1933 in a third-floor apartment of the Takekawaya Building in Roppongi, Azabu Ward, Tokyo. Its objective was to produce high-grade cameras.

A young man named Goro Yoshida, a passionate camera-lover; and his brother-in-law, Saburo Uchida, set up the Laboratory jointly. Their aim was to make cameras that could compete with the German models that were considered the most advanced of the day.

They started by analyzing existing cameras, which were difficult to obtain. Systematically, they studied each camera’s internal workings, examined mechanisms, drew up design diagrams and procured parts. Takeshi Mitarai, a close friend of Uchida provided the funds required for the research. Mitarai later became president of the company and built its foundation.

It then went on to become a renowned camera making company. When it grew and decided to diversify its business plans it had to shed its image of a company that manufactured only cameras, therefore the top brass of the company decided to take on the name Canon Inc in 1969. The year1969 was also the year that canon forayed into business machines and eventually into the printing business.

Product Chronology

To go through a brief chronology of Canon’s printing and copying history - Canon successfully developed the laser beam printer in 1975. In 1982, the PC-10 and PC-20, the world’s first personal copying machines with replaceable cartridges, were introduced. Canon, in collaboration with IBM Japan, Ltd., developed the world’s first notebook PC with an installed printer in 1993.

Bubble Jet Discovery

One of canon’s most interesting discoveries in the field of printing technology was the bubble jet printing technology. Researchers while working on the inkjet printing technology hit upon the discovery when a hot solder gun accidentally touched the tip of an ink-filled needle due to which ink sprayed out! Therefore, the researchers concluded that heat instead of pressure could be used to eject the ink on the media.
The development of this technology gave the world it’s first bubblejet printer in 1981.

Laser Beam Printing

Another important technology in the field of printing by Canon was the development of laser beam printers (LBP). It started research on laser as a means of writing as early as 1962. However it was unable to develop a practical laser source and hence could not acquire the patents it had applied for due to which the research and development was suspended.

In the 1970s when lasers came into practical application fields Canon resumed its research on laser beam printers and developed the LBP’s of today combining their electro photographic technologies with laser technology.

The development of lasers imprinting also gave birth to a number of high-speed copy machines by Canon such as The NP-8500, the world’s first retention-type copying machine in 1978.

The NP-8500 SUPER, an ultrahigh speed-copying machine capable of producing 135 copies per minute 1981; and the PC-10 and PC-20, the world’s first personal copying machines with replaceable cartridges were introduced by Canon in 1982.

In 1984 Canon gave the world its LBP-8/CX, the smallest and lightest laser beam printer.

Today Canon develops technology that couples direct printing options from Cell phones equipped with a digital camera, hence integrating printing technology with photography! One such latest technology is the direct wireless printing from a camera! The printing is achieved using infrared and Bluetooth communication technology embedded in the cell phones or PCs. Being wireless no cables are required, and the image quality parallels that of printouts from PCs using memory cards.

One important feature Canon uses to achieve real true to life image quality on paper is:

Color reproduction: The color range of digital cameras (YCC) is much wider, making it possible to capture a vast amount of color information when shooting. To achieve similar quality Canon added red ink and green ink, which offers high brightness and chromaticity, to the six existing inks in their inkjet printers, raising the saturation of the red and green output range by 1.6 times and 1.2 times respectively. The result is photo image output with improved depth and translucence, and color reproduction comparable to that of prints from photo film.
